TERMS AND CONDITIONS
CUSTOM COVER TERMS AND CONDITIONS:
Custom Covers will come with an ebook, one full-wrap, title png, 3d renders, ARC cover, and social media banners. Additional full wraps for different retailers can be added, as well as audibook covers, for additional fees..

Custom covers will be designed based on author specifications. At the beginning of the month that we are to complete your cover, we will discuss those specifications through the media of your choice: text, messages, email, or phone.
All sales are final and will not be refunded under any circumstances.
Custom covers are made with stock photos unless the author has a photo selected and purchased. Licensing will need to be shown if the author purchases the photo. Any stock photo selected by me will never be used again for a cover designed by me. I cannot guarantee that the same photo will not appear on another cover or another author will not buy the photo on his/her own and bring it to me for a design.

Custom covers cannot be resold. By purchasing a custom cover, you agree to all the terms and conditions listed on this page.

​Please plan to have your information prepared for a custom cover at least one month prior to when you need the cover (minimum). This gives us time to work on and make revisions to your cover.

Custom Covers come with 3 revisions. Anything after that will be an additional fee.
Modifications will be completed and final files provided to you by the date you give me. Please note, that files will be delivered on the evening of the date you give me since I have a full time job and work on covers in the evening.
Customization of text, images, etc. is included in the purchase price.

PREMADE COVER TERMS AND CONDITIONS:
Premade Covers will come with an ebook, one full-wrap, and title png and 3d renders. Additional wraps and audiobook covers can be added for an additional fee.

Premades are available on a first come, first served basis. Once they are sold, they are never sold again.
All sales are final and will not be refunded under any circumstances.
Premade covers are made with stock photos, so while I will never use that photo again, I cannot guarantee that the same photo will not appear on another cover.

Premade covers cannot be resold. By purchasing a premade cover, you agree to all the terms and conditions listed on this page.

​Modifications to premade covers must be scheduled one week ahead of time.
Modifications will be completed and final files provided to you within one week of scheduling.
Customization of text is included in the purchase price. Modifications to fonts will be an additional charge.

CANCELLATION:
​In the event of a cancellation before work has started, no further expenses will be owed. If the work has begun on the project, the remaining balance will be owed. Once work is booked, no refund will be given.
​
​OWNERSHIP:
Enchanting Romance Designs maintains the full rights of all original designs. Designs and their concept, including layout, image style, placement, and fonts aren’t permitted to be recreated by another person.
​The Client maintains the rights to the stock photo that they have downloaded. ​
​
Enchanting Romance Designs controls the limited rights to the cover to use as any sort of self-promotion, portfolio, client viewing, etc.

​ATTRIBUTION:
​Enchanting Romance Designs requires cover design credit appear in Client’s book, whether on the cover or inside on the copyright page.

​LIABILITY:
Enchanting Romance Designs isn’t liable for damages of any kind, including loss of revenues, profits, business, reputation, or data, in any way related to our services. Enchanting Romance Designs isn’t responsible for any claim, loss, or injury based on errors or inaccuracies appearing on our site or in our clients’ written documents once the cover has been approved.
​Should Enchanting Romance Designs take longer to complete the project than originally indicated i.e. family emergency, act of nature, the Client will be contacted via phone or email in order to agree upon a new project completion date.
​
PUBLISHING RIGHTS:
Client agrees to abide by the terms of any license agreement for any royalty-free stock images licensed by Enchanting Romance Designs through any third-party provided for use in final design. Print runs of up 500,000 are included in licensing, depending on the source. Additional licensing fees will be required once this threshold has been reached and is the responsibility of The Client to pay for additional licensing as needed.

​CODE OF FAIR PRACTICE:
Enchanting Romance Designs acknowledges that to the best of her knowledge, the work prepared is an original creation and has not been previously published and/or consent to use has been obtained. The work prepared does not contain any scandalous, libelous, or unlawful matter. The Client and/or others may not use Enchanting Romance Designs product in any way that may infringe upon the rights of others.

A NOTE ON ARTIFICIAL INTELLIGENCE / AI STOCK PHOTOS:
I do not support, nor will I ever knowingly use AI generated images on covers, teasers or promotional graphics. As an artist, I would never want to harm another artist, and want them to be acknowledged and fairly compensated for their work.
With AI images appearing on paid stock sites, and with them often not disclosing what is and isn’t AI generated, it’s becoming harder to discern. I’m looking into the use of AI detector tools for the images I pull/purchase from stock sites. However AI, by nature, is ever evolving. These tools are new, and I expect they will have flaws, and occasionally miss the mark.
That being said, if I unknowingly use an AI generated image in any cover/teaser/promo graphic that I design, I will be transparent and remove it. I will also work with the author, book box, etc. to re-design something new as soon as possible.
This is a pretty terrifying time for artists. I vow to continue to create with integrity, and to honor the artist community as best as I can.

​ACCEPTION OF TERMS:
​Both Enchanting Romance Designs and the Client will acknowledge acceptance of these terms when they agree to work together. By acknowledging this contract, the Client agrees to hold Enchanting Romance Designs entirely free from any liability, including financial.
​
Agreement:
This agreement is the entire agreement of all parties. No additional promises or conditions, written or oral, apply to this agreement that are not included herein. Upon delivery of final files, this agreement is considered fulfilled.
